Schedule of EU pre-registration stages and the public placement


Q: Brand rights – we have the brand rights for xxx-property. Are we also entitled to protect these rights for the domain “property.eu” in the first Sunrise stage?

A: The “rule book” – the detailed regulation, as specified, should be published through the month of September 2005 online under: http://www.validation.pwc.be and under http://eurid.eu. I can correctly answer this question after that. Certainly at present, a valid brand of each participating country will be of value “nonetheless.” It is therefore not necessary to own a team brand. You will be given the option of registering the described brand xxx-property.eu and xxxproperty.eu. However, my opinion is that the registration of property.eu will not be possible.

Q: How can I keep track of my domain order?

A: You receive your own customer login (free) from Aktualisierer. Within this area, to begin with, you see your “wish list” of domains and after payment you see the confirmation notification that we will submit the respective domains to the respective Sunrise stages. After the start of the transmission on EURid, a special .eu Whois database will be put on the pages of EURid. This enables you to retrieve the following data for the given domain names:

1.) How many applications EURid has received for these domain names and in which order these applications went into the registration system.

2.) Name and address of the applicant

3.) Qualifying date for the applicant, in order to send the documentation to the validation agent.

4.) The date when the documentation is entered on EURid

5.) The status of the application (Pending, Accepted, Rejected, etc.)

Q: What can I do if I think that EURid or PWC (PriceWaterhouseCoopers) has made a mistake in regard to their assessment of my application?

A: Both parties will undertake every effort to be sure that all applicants will be handled correctly and to the best of one’s knowledge and belief. Nevertheless, in case you believe that your application has not been assessed correctly, you have the option to contest the decision in an “Alternative Dispute Resolution Service.” This service will still be set up for those that presume that the Registry acted contrary to the “Public Policy Rule.”

Please notice: In case they register the objection in order to transfer the names to another person, registration could be annulled and not be transferred to the petitioner. If another application for the domain names is in the waiting line, it will be processed. If there is no other applicant for the name, the domain name will be released on the “first-come-first-served” principle to the general registration after development of the “Sunrise Stage.”

Q: A registered domain’s period of validity

A: A .eu domain will be registered with a period of validity for one year. The domain will be extended after the anniversary and the Registrar will debit the registration fees from this account.

Q: Who settles disputes?

A: For disputes about “.EU” domains, according to an order of the European Parliament, one’s own arbitration is provided for. It has been arranged according to EU regulation by a procedure similar to the UDRP (Uniform Domain Name Dispute Resolution Policy), as the WIPO (World Intellectual Property Organization) has offered for years, among other things.

EURid, therefore, for this purpose, assigned an out of court arbitrator for disputes about .eu domains in Prague-based arbitration court of the Economic- and Agro-Chamber of the Czech Republic. (www.arbcourt.cz/de/ce_index1.htm)

Q: What does first-come, first-served mean?

A: The first come, first served principle is the type of order processing that comes from all official .EU Registrars and EURid.

All applications for pre-registrations, Sunrise pre-registrations and normal domain applications after the Landrush, will be provided with an exact Timestamp and dealt with in the rank of the placed orders.

The procedure is not adopted voluntarily at the .EU registration, but rather is a component of EU Regulation 874/2004 from 28. April 2004 (Article 5, Paragraph 2) and EU Regulation 733/2002 of 22. April 2002.

Q: Which EU domains cannot be used for the registration?

A: Eurid.eu; registry.eu, nic.eu, dns.eu, internic.eu, whois.eu, das.eu, coc.eu, eurethix.eu, eurethics.eu, euthics.eu

Q: What if I believe that a Sunrise .eu domain from the applicant has been speculatively or improperly registered?

A: Each party can initiate an ADR procedure against another party that has registered a .eu domain if criteria for a speculative and improper registration have been given according to Article 21 of the Public Policy Rules.

If the ADR committee validates the complaint, the domain name can be transferred to the claimant, provided that they satisfy the criteria for registration.

Q: How did the procedure in the Sunrise stages function befor April 6th ?

A: During the “Sunrise Stage” applicants for a .eu domain will be handled according to the “first come, first served” principle.

Each applicant for a domain name must supply us with acceptable evidence for the claim of the name within 40 days. Should an application be successfully allowed, the domain name will be given to the applicant. The domain name will first be useable after a 40-day period in order to allow for any mistakes and complaints. All future applications for the same name will be notified. All applications will be openly and visibly displayed with submission of the domain name.

Should the first applicant for a domain name not manage to supply the evidence within the 40-day period, the application will be rejected. The validation agent then checks the second application, and all further application respectively, until a valid application has been found. If none of the applicants can supply valid proof for the name within the 40 day period, the domain name will be released again and will again be able to be registered according to the “first come, first served” principle.
